All work is offered on a project by project basis. You are under no obligation to accept any project or perform a minimum number of projects. All work is paid for based on each project rate. You may use any number of workers to help you on projects, however, you will only be paid on a project basis, and it will be your responsibility to pay for any of your workers.
You are responsible for furnishing, at your own expense, all of the necessary workers, materials, equipment, supplies and tools (i.e., duster, scraper, box cutters, etc.) needed to complete each project that you accept. You are solely responsible for any travel or other costs or expenses incurred by you or your workers in connection with the performance of work, and in no event will AJIS Retail Solutions reimburse you or your workers for any such costs or expenses.
You and your workers may be engaged or employed in other businesses, trades, professions, or other activities while performing work for AJIS Retail Solutions.
You will be offered a project rate based on industry standards.
AJIS Retail Solutions will not control or direct the manner or means by which you or your workers perform the work needed to complete each project, including but not limited to the time you or your workers perform the work. However, you understand and acknowledge that certain clients at project work sites may require work to be performed during specified business hours.
By accepting a project, you represent and warrant that you are customarily engaged in an independently established business to perform the work needed to complete each project. As an independent contractor, you are encouraged to obtain a business license, and to consult with your tax advisor regarding tax deductions.
By accepting a project, you represent and warrant that you and your workers have the required skill, experience, and qualification to perform the work needed to complete each project, and that you and your workers will perform the work in a professional and workmanlike manner in accordance with generally recognized industry standards for similar work, and you will devote sufficient resources to ensure that the work is performed in a timely and reliable manner. Repeat business comes from doing the job correctly. WE DO NOT PROVIDE TRAINING. Do not accept any work that you do not have the skills for. If the work is not performed correctly, you are expected to correct the problem at your cost or risk non-payment.
You and your workers are independent contractors, and the performance of any work for any project shall not be construed to create any association, partnership, joint venture, employment, or agency relationship between you or your workers and AJIS Retail Solutions for any purpose. You and your workers will not be eligible to participate in any vacation, group medical or life insurance, disability, profit sharing or retirement benefits, or any other fringe benefits or benefit plans offered by AJIS Retail Solutions to its employees, and AJIS Retail Solutions will not be responsible for withholding or paying any income, payroll, social security, or other federal, state, or local taxes, making any insurance contributions, including for unemployment or disability, or obtaining workers' compensation insurance on you or your workers’ behalf. You shall be responsible for, and shall indemnify AJIS Retail Solutions against, all such taxes or contributions, including penalties and interest. Any persons employed or engaged by you in connection with the performance of any work shall be your employees or contractors, and you shall be fully responsible for them and fully indemnify AJIS Retail Solutions against any claims made by or on behalf of any such employees or contractors.
You acknowledge that AJIS Retail Solutions is not responsible or liable for any injury, accident, damage to property, etc., that may occur during the performance of any project work, and that you will maintain adequate insurance to cover all activities of you and your workers relating to such work.
You acknowledge that you will receive an IRS Form 1099 from AJIS Retail Solutions, and that you shall be solely responsible for all federal, state, and local taxes. You also acknowledge that as an independent contractor, you may not qualify for unemployment benefits.
You will need to sign and return a separate Independent Contract Agreement and provide an IRS Form W-9 prior to performing any work for any projects.
